HOUSE RULES

The Fetish Suite is located in an apartment building with its own entrance. We therefore ask our guests to exercise discretion when arriving and departing as well as during their stay in public areas. Please arrive in normal clothing, not for example in a latex outfit or other conspicuous fetish clothing or SM clothing. This is the only way we can maintain peace with our neighbours.

A surveillance camera is installed in the entrance area for security purposes. The camera only films vertically from above between the entrance door and the end of the stairs, so that your privacy is protected. You are welcome to cover your face; the camera is only used for security purposes and to check the number of people.

Use of the Fetish Suite is only permitted for the number of people registered with us. Additional guests must be registered with us (even at short notice). Persons not registered will be charged a flat rate of 100 euros per person per day.

If someone is added spontaneously, simply send us a short e-mail to fetish-suite-berlin@gmx.de stating the additional number of people.

Smoking is not permitted in the Fetish Suite. If the smoking ban is not adhered to, we reserve the right to charge the costs for additional cleaning and removal of smoke odours.

There is an ashtray outside the front door by the entrance which you are welcome to use.

Please note, however, that this is a publicly visible area and appropriate clothing must be worn!

Please close the windows while playing. Neighbours are tolerant but should not be overly bothered.

The use of drugs and other illegal substances is prohibited.

Persons under the influence of alcohol or drugs may be expelled from the suite and the private grounds! In this case, the rental price will not be refunded.

Persons under the age of 18 are not permitted to stay in our flat.

Windows must be closed when it is raining, cold or when leaving the house. The doors must always be closed.

Commercial letting is strictly prohibited; the flat is NOT a place of prostitution.

Animals are not permitted in the Fetish Suite.

The use of all equipment and toys is at your own risk!

If used improperly, the use of BDSM equipment and accessories can lead to permanent damage and injury (etc.).

We do not accept any liability for accidents or their consequences. The use of our premises and all items contained therein is exclusively at your own risk.

The hirer is liable for culpable damage to the Fetish Suite, the furniture and other fixtures and fittings.

Instruction on unfamiliar equipment can be provided on request.

If damage occurs, please let us know immediately. We will certainly find a solution.

Please use insertable toys only with a condom (condoms are available in the suite).

All used toys and equipment must be thoroughly cleaned after use and placed in the boxes provided for disinfection; these are available in every room. We will take care of the professional disinfection.

The flat must be returned tidy, clean and swept clean. Used crockery must be put away in the dishwasher.

Golden shower games are only permitted in the shower.

Scat, vomit and wax games are absolutely forbidden.

Soiling caused by oil, body fluids etc. must be thoroughly removed by the tenants.

If the suite is not left properly – i.e. not swept clean – we reserve the right to charge an emergency cleaning and disinfection fee of 500 euros so that the suite can be professionally prepared for the next guests as quickly as possible.

In the event of a breach of the house rules, we reserve the right to enforce our domiciliary rights and may assert claims for damages.

GENERAL TERMS AND CONDITIONS

AGB

I. Conclusion of contract, contractual partners, contractual liability and limitation of contract.

  1. The contract is only concluded a) when the customer has paid online. b) – if this option is offered by Fetish Suite Berlin by writing – the written reservation confirmation of Fetish Suite Berlin is confirmed by the customer by e-mail (without signature) and this confirmation has been received by Fetish Suite Berlin.
  2. The contracting parties are Fetish Suite Berlin and the customer. If a third party has ordered on behalf of the customer, the third party shall be liable to Fetish Suite Berlin together with the customer as joint and several debtors for all obligations arising from the contract, provided that Fetish Suite Berlin has received a corresponding declaration from the third party.
  3. If the reservation confirmation deviates from the content of the registration, the content of the reservation confirmation shall become part of the contract, unless the guest objects immediately, at the latest upon acceptance of the services.
  4. Fetish Suite Berlin is liable for its obligations arising from the contract. In the area not typical for the service, liability is limited to intent and gross negligence on the part of Fetish Suite Berlin.
  5. The limitation period for all claims of the customer is 6 months. This limitation of liability and short limitation period shall also apply in favour of Fetish Suite Berlin in the event of breach of obligations in the initiation of the contract and positive breach of contract. The shortening of the limitation period does not apply to claims for damages resulting from injury to life, body or health that are based on a negligent breach of duty by Fetish Suite Berlin or an intentional or negligent breach of duty by a legal representative or vicarious agent of Fetish Suite Berlin. Furthermore, it does not apply to other damages that are based on a grossly negligent breach of duty by Fetish Suite Berlin or on an intentional or grossly negligent breach of duty by a legal representative or vicarious agent of Fetish Suite Berlin.

II. Services, prices, payment, offsetting

  1. Fetish Suite Berlin is obliged to keep the rooms booked by the customer available and to provide the agreed services.
  2. The customer is obliged to pay the applicable or agreed prices of Fetish Suite Berlin for the provision of rooms and any other additional bookings of equipment utilised by the customer.
  3. The agreed prices include the respective statutory value added tax. If the applicable VAT rate changes, Fetish Suite Berlin is entitled to adjust the prices to the new VAT rate.
  4. The prices may also be changed by Fetish Suite Berlin if the customer subsequently wishes to change the number of persons booked or the length of stay of the guests and Fetish Suite Berlin agrees to this.
  5. If the guest, for whatever reason, does not make use of the equipment booked during his stay at the Fetish Suite Berlin, he is not entitled to a refund, not even proportionally, nor to a price reduction.
  6. If the guest cancels his/her stay prematurely, he/she shall remain obliged to pay the full amount booked; there shall be no refund.
  7. The customer may only offset or reduce a claim by Fetish Suite Berlin with an undisputed or legally binding claim.

III. Withdrawal by the customer (i.e. countermand, cancellation) / non-utilisation of the apartment’s services

  1. For cancellations / countermands of contractually agreed services (according to clause II, number 1), the cancellation conditions agreed with the reservation confirmation of Fetish Suite Berlin apply. These cancellation conditions are already visible to the customer / guest before the binding booking / reservation (during the booking process).
  2. Cancellations / countermand must be sent to Fetish Suite Berlin in text form.
  3. Cancellation by the customer of the contract concluded with Fetish Suite Berlin requires the written consent of the accommodation. If this is not given, the agreed price from the contract must be paid even if the customer does not make use of contractual services. This shall not apply in cases of default of performance by Fetish Suite Berlin or impossibility of performance for which it is responsible.

IV. Cancellation by Fetish Suite Berlin

If the customer’s right to cancel the contract free of charge within a certain period has been agreed by the hotel in writing, the apartment is entitled to cancel the contract during this period.

  1. Furthermore, Fetish Suite Berlin is entitled to withdraw from the contract extraordinarily for objectively justified reasons, for example if – force majeure or other circumstances for which the flat is not responsible make fulfilment of the contract impossible
  2. Fetish Suite Berlin must inform the customer immediately of the exercise of the right of cancellation.
  3. In the event of justified cancellation by the hotel, the customer shall have no claim to compensation.

V. Room provision, -handover and -return

  1. Booked rooms are available to the customer from 15:00 on the agreed day of arrival.
  2. On the agreed day of departure, the flat must be vacated and returned to Fetish Suite Berlin by 11:00 a.m. at the latest. The customer has the option of booking a “late check-out” (late departure) subject to prior agreement (requires the consent of Fetish Suite Berlin). This shall not give rise to any contractual claims on the part of the customer.

VI. Liability

  1. Fetish Suite Berlin is not liable to the customer for any items brought in.
  2. The guest is fully liable to Fetish Suite Berlin for all damages and defects caused by him or his fellow travellers. The guest is also liable for the possible non-rentability of the flat resulting from these damages.
  3. The guest is also liable for the loss of the Fetish Suite Berlin in the rooms provided.
  4. Fetish Suite Berlin is entitled to claim damages by way of a lump-sum claim or to estimate the individual damage and make the amount due for payment immediately. The guest is at liberty to prove that Fetish Suite Berlin has incurred no or less damage than the compensation demanded.
  5. The guest is not entitled to make payments until he has reported the damage to his insurance company, as Fetish Suite Berlin is entitled to demand immediate payment of the amount of damage.

VII. Food and drinks brought in

  1. In all rooms of the Fetish Suite Berlin, the consumption of food and beverages brought in is permitted.

VIII. External service providers

  1. External service providers or other third parties are not permitted to provide their commercial services in the flat without the written consent of Fetish Suite Berlin.

IX. Miscellaneous

  1. For reasons of hygiene, pets are not permitted in the entire flat.
  2. All rooms of the Fetish Suite Berlin are non-smoking areas.
  3. We reserve the right to correct errors as well as printing and calculation errors.

XI. Final provisions

  1. Amendments or additions to the contract, the acceptance of the application or these terms and conditions for accommodation must be made in writing and require the written confirmation of Fetish Suite Berlin. Unilateral amendments or additions by the customer are invalid.
  2. Place of fulfilment and payment is online payment to be made immediately to Fetish Suite Berlin.
  3. German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods and the conflict of laws is excluded.
  4. Should individual provisions of these General Terms and Conditions for Accommodation be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions shall apply.
